Kathleen Keating’s commercial litigation practice has evolved over many years to several areas of experience relevant to property owners, operating businesses and secured lenders. She has also developed experience representing commercial landlords in payment disputes and eviction proceedings.

In the area of liquor license matters, Kathleen has extensive experience in all aspects of regulatory compliance for proposed license transfers, license applications, bankruptcy sales of licenses and operation of licensed businesses. This knowledge is valuable to licensees, owners/landlords and secured lenders entangled due to nonperforming loans. In particular, she has advised lenders faced with the need to preserve the value of mortgaged premises, including the implications of engaging receivers/property managers to continue operations most notably at underperforming hotels.

With respect to construction matters, Kathleen has for many years represented private owners undertaking projects to build and renovate schools, hospitals and similar facilities. Such representation included negotiation and drafting of construction contracts in prior years and has more recently involved advice on payment and lien claim situations, including guidance on troubled projects.

Previously, Kathleen served for many years as key counsel to the court-appointed Trustee in liquidation proceedings under the Securities Investor Protection Act.
