The past year has seen state supreme courts closing out and resolving ongoing questions regarding coverage for Covid-19, including the recent certification decision by the California Supreme Court in Another Planet. Courts are considering the scope of application to other types of coverage. One recent battleground for that has been in motions across the country regarding aviation policy coverage for the seizure of aircraft in Russia, which have reached a mix of decisions on the applicability of Covid-19 decisions to aviation policies. Jennifer Farina joins this Women in Insurance Network Regional CLE Program Panel, which educates participants on the status of current litigation on “physical loss” coverage in first-party policies, including some of the recent arguments and decisional history across the country, and discuss possible implications for “physical loss or damage” coverage in a variety of policies.
