McCarter Claims Victory in Connecticut Appellate Court in Implied Easement Case

Congratulations to the McCarter team of Adam Swanson and Alexa Derkasch in securing a victory for a client against a claim for an implied easement. The Appellate Court affirmed the trial court’s grant of summary judgment on proof that there was no necessity for an implied easement, despite a finding of material issues of fact on other elements. The McCarter team successfully argued the winning summary judgment motion in the trial court and the winning re-argument motion after summary judgment was initially denied in this first impression decision from the Connecticut Appellate Court.
