NJ Supreme Court Adopts McCarter’s Position in a Medical Device Products Liability Case

The New Jersey Supreme Court rendered a July 25, 2023 opinion adopting McCarter’s position that the trial court improperly excluded evidence of FDA 510(k) clearance for our client’s medical devices, and affirmed the opinion of the Appellate Division ordering a new trial. McCarter & English partner David Kott presented oral argument in the New Jersey Supreme Court and partner Natalie Mantell was on the briefs.
