Medical device manufacturer—Defense verdict and Second Circuit win

Served as lead trial and appellate counsel, and obtained a complete defense verdict in the Southern District of New York and a Second Circuit affirmance for our client, a medical device manufacturer. The plaintiff alleged that the client failed to fulfill its obligations under two agreements between the parties related to the development of a next generational medical device, and sought damages in excess of $8 million. 

Multinational pharmaceutical company—Proton-pump inhibitor litigation

Defendants’ liaison counsel and lead New Jersey counsel for a major multinational pharmaceutical company in the New Jersey state court multi-county litigation (MCL) involving a class of heartburn medicines.

Medical device manufacturer—Appellate counsel in New Jersey pelvic mesh MCL

Responsible for appellate strategy and briefing for a multinational medical device manufacturer involved in the pelvic mesh multi-county litigation, including in an appeal involving two issues of first impression for New Jersey appellate courts.

Fortune 50 medical device company—New Jersey hernia mesh MCL

Member of the case work-up and briefing teams for a multinational Fortune 50 company and its subsidiary in hernia mesh cases pending in a New Jersey MCL.

Successfully obtained an affirmance of summary judgment for our client on several grounds in a hernia mesh MCL case.

Represent a multinational company and its subsidiary as appellate counsel in a New Jersey state court MCL related to a medical device, which involves advising on preserving issues for appeal, dispositive motion briefing, and general litigation and appellate strategy.

Successfully opposed petition for certification to Supreme Court of New Jersey following the Appellate Division’s affirmance of summary judgment for our client.

Multinational medical device company—Product liability counseling

Provide product liability and risk mitigation counseling to multinational medical device manufacturer, including collaborating with business leaders in strategic meetings, conducting employee training, and reviewing FDA submissions, product warnings, recall communications, consultant presentations, and surgeon-facing, direct-to-patient, and internal marketing materials.

Advised a multinational medical device company on the development of a physician advisory board.
