Title Insurance Company—Connecticut appellate court victory

Secured a victory for a title insurance and real estate services company, against a claim for an implied easement. The Appellate Court affirmed the trial court's grant of summary judgment upon proof that there was no necessity for an implied easement, despite a finding of material issues of fact on other elements. The McCarter team drafted the winning appellate brief in this first impression decision from the Connecticut Appellate Court, the winning summary judgment motion in the trial court, and the winning re-argument motion after summary judgment was initially denied. This was a rare victory to have the trial judge reverse his own decision based upon compelling arguments that the Court misinterpreted the law in its initial decision.
