Kenneth McPherson III represents clients in a wide range of real estate and government affairs matters involving land use and zoning approvals, development and licensing rights, economic incentives, affordable housing, and public records compliance and related litigation. This work includes handling actions in lieu of prerogative writs and appellate proceedings involving redevelopment area designations, development application denials, and other governmental actions affecting real property rights before all levels of New Jersey state courts.
Capitalizing on his previous experience as a former member of and later counsel to the Township of West Orange Planning Board as well as a member of the Morristown Rent Leveling Board, the Morristown Environmental Commission, and the Morristown Housing Authority, Ken helps clients submit and obtain approvals of applications to local governmental entities in connection with municipal land use entitlements and property tax exemptions. He navigates developers of industrial, commercial, and residential projects in New Jersey through the land use and redevelopment process.
In addition, Ken counsels applicants seeking state and municipal licensure for cannabis and alcoholic beverage operations (including liquor licensing) and represents property owners and commercial operators in ordinance-violation and enforcement proceedings in New Jersey state and municipal courts.
He also advises clients on due diligence and regulatory compliance in transactional matters, including concerning acquisitions and dispositions of state-licensed healthcare facilities and flood risk disclosure obligations.
Prior to private practice, Ken served as Chief of Staff & Legislative Counsel to the Majority Whip of the New Jersey General Assembly. During law school, he served as a legislative aide to the Chairman of the Judiciary Committee of the New Jersey General Assembly.
He has authored articles in the New Jersey Law Journal addressing emerging affordable housing development incentives and environmental regulatory issues affecting the real estate development industry in New Jersey.
