David Kott to Appear for Amici in New Jersey Supreme Court in Action Involving Enforceability of Arbitration Agreement

The New Jersey Supreme Court has granted a motion filed by McCarter & English partner David Kott seeking leave for the New Jersey Business and Industry Association, the New Jersey Chamber of Commerce, and the Commerce and Industry Association of New Jersey in County of Passaic v Horizon Healthcare Services. David will present oral argument that the NJ Supreme Court decision in Atalese v Legal Services Group should not apply to arbitration agreements between businesses and other large entities.
