Urban Outfitters Inc. filed suit in Pennsylvania state court Wednesday accusing two of its insurers of failing to defend the retailer from claims leveled by Unicolors Inc. over a dress pattern that allegedly infringed company copyrights.
A complaint in Philadelphia County’s Court of Common Pleas accused the Hanover Insurance Co. and the former OneBeacon America Insurance Co. of forcing Urban Outfitters to foot the bill for its own defense in one of two copyright infringement cases it was roped into over the dress design.
“Hanover and OneBeacon have deprived and continue to deprive Urban Outfitters of the benefit of the insurance protection for which substantial premiums have been paid,” the complaint said. “In evaluating their obligations under the policies, Hanover and OneBeacon have failed to accord the interests of Urban Outfitters the same faithful consideration that they have given their own interests.”
