Defended a multinational appliance manufacturer in a New Jersey federal court which alleged that certain washing machines manufactured by our client were improperly marketed as Energy Star-qualified. Successfully moved to dismiss plaintiff’s state law claims alleging deceptive marketing, arguing that those legal claims are pre-empted by federal regulation.
