Jane Kimball has more than 25 years of experience practicing in the area of Employee Benefits and ERISA, counseling clients with respect to a broad range of matters, including the design, drafting, implementation, administration, and termination of qualified retirement plans (including defined benefit plans, Section 401(k) plans, and ESOPs), Section 403(b) and Section 457 plans, and nonqualified plans. She advises on structuring and drafting executive compensation and other nonqualified deferred compensation plans to comply with Section 409A and other tax laws. She also counsels employers on a broad range of matters pertaining to the impact of ERISA, COBRA, and HIPAA, and various tax laws upon their group health and cafeteria plans and other welfare plans.
She has achieved many excellent outcomes for clients interfacing with the Internal Revenue Service, Department of Labor and PBGC. She also represents clients in connection with the employee benefit aspects of business transactions, including mergers, acquisitions and dispositions. Jane’s practice also includes controversy work. Prior to joining McCarter, Jane handled a variety of tax litigation as a Trial Attorney with the U.S. Department of Justice. Since joining McCarter, Jane has teamed with members of the Business and Financial Services Litigation Practice Groups representing clients in various ERISA benefit claim disputes and litigation.
