Kelly Garrone has extensive experience in both transactional aspects of intellectual property law as well as intellectual property litigation. In the area of trademark law, she regularly counsels clients from a wide variety of industries in every step of securing and protecting a brand name, from choosing a trademark to engaging in litigation and other enforcement efforts to enforce rights in that mark. She assists clients with trademark selection and clearance, as well as all aspects of the trademark registration process in the United States. For more than 20 years, she has represented clients in trademark registration and enforcement inter partes proceedings before the U.S. Patent and Trademark Office, including litigating trademark opposition proceedings, as well as handing other trademark oppositions, cancellation proceedings, and concurrent use proceedings. She also routinely assists clients with developing global brand strategies involving the registration and enforcement of trademarks abroad to protect and defend the trademark rights of clients.
Kelly also counsels clients regarding the protection, strategy, and proper use of intellectual property in other areas, including copyright, trade dress, trade secrets and confidential information, as well as assisting clients with due diligence issues relating to intellectual property. In addition, she has experience drafting and negotiating agreements relating to various aspects of intellectual property, including licenses and other agreements relating to trademarks, copyrights, and technology, manufacturing agreements, as well as confidentiality and non-compete agreements, and settlement agreements.
Kelly also represents clients involved in trademark, trade dress, copyright and patent infringement litigation as well as other intellectual property and commercial litigation matters including trademark counterfeiting, dilution, unfair competition, cybersquatting, trade secret misappropriation, and breach of confidentiality and non-compete agreements.
