Kristofor Henning’s practice focuses on commercial and consumer litigation for his corporate clients, including lengthy experience defending class action litigation. He also has significant experience defending employment litigation for his clients. Kris represents clients from a variety of industries, including technology, pharmaceutical, and healthcare.

While the great majority of Kris’s career has been spent in a law firm, he also spent approximately 3‒5 years as a Vice President in the litigation department at Hewlett Packard Co. and then Hewlett Packard Enterprise Co. As a result, Kris has developed a unique insight into the needs, concerns, pressures, and priorities of his corporate clients. Using this experience, Kris is able to combine an in-depth understanding of his clients’ business with innovative litigation strategies to achieve results that prioritize his clients’ business interests.

Obtained the dismissal of all claims asserted against Hewlett Packard Enterprise Co. in a New York state court litigation seeking millions of dollars in damages in connection with plaintiff’s allegations that he had been denied just compensation for his share of a business acquired by HPE. The court dismissed the complaint in its entirety prior to discovery.

Secured the voluntary dismissal of a NJ federal court class action targeting a U.S. chemicals company and its former parent over allegations of environmental contamination. After the McCarter team filed a motion to dismiss and motion to strike the class allegations, the plaintiff voluntarily dismissed the litigation.

Obtained summary judgment victory in New York state court litigation brought by former business partner seeking at least $45 million in alleged damages.

Defeated class certification and obtained summary judgment on all but one claim of a purported class action asserting NJ consumer protection and warranty claims alleging defective toilet parts. Remaining claim was favorably settled.

Obtained dismissal of class action asserting claims under New Jersey Truth in Consumer Contract, Warranty & Notice Act (leading to favorable settlement on appeal).

Defeated class certification in ERISA breach of fiduciary duty litigation against retirement plan administrator.

Defeated class certification in ERISA breach of fiduciary duty litigation arising out of termination of post-retirement health benefits.

Lead drafting of successful motion to dismiss class action asserting fraud based claims against pharmaceutical company.

Obtained dismissal, summary judgment, or defeated class certification in multiple class actions asserting California consumer protection/warranty and other related claims.
