Thomas Ladd has more than 30 years of experience in a practice focusing on diverse areas of litigation, including insurance coverage matters, product liability and general litigation. In recent years, his practice has focused principally on insurance recovery efforts on behalf of large- and medium-sized corporate clients in complex matters which are litigated and arbitrated throughout the United States and in London, England. Tom has secured billions of dollars in insurance assets for a broad range of policyholder clients.
The bulk of his practice involves seeking recovery of insurance proceeds from insurance companies for liabilities related to environmental contamination, asbestos exposure and product hazards. Tom has also handled insurance coverage disputes on behalf of corporate clients involving directors’ and officers’ coverage, retrospective premium disputes, errors and omissions coverage, property disputes, fiduciary liability disputes, coverage under crime policies, and product recall matters.
Tom has served as lead counsel in numerous insurance coverage matters, including “Bermuda Form” international arbitrations for major U.S. pharmaceutical companies involving product liability losses, with the amounts in dispute exceeding hundreds of millions of dollars; several London-based arbitrations for another major U.S. pharmaceutical company involving insurance coverage for product liability losses, also with amounts in dispute exceeding several hundred million dollars; and various major U.S. corporations involving insurance coverage for environmental, asbestos and product losses. In addition, he has provided advice to numerous major U.S.-based and multi-national corporations on pursuing insurance coverage through arbitrations in various international settings. Tom has also appeared in various pro hac vice admissions. During the course of his career, he has served as lead trial counsel for former asbestos manufacturers in numerous cases which were tried to conclusion.
In connection with his practice, he has argued dozens of motions and applications before state and federal trial and appellate courts, as well as international arbitral tribunals involving a variety of substantive and procedural issues. Tom has also conducted hundreds of offensive and defensive depositions. In addition, Tom has also appeared in multiple pro hac vice admissions in other jurisdictions.
In addition to his litigation and arbitration work, Tom regularly provides insurance coverage advice to clients by considering the adequacy of their insurance programs, assessing potential risks and advising on insurance issues related to corporate transactions and bankruptcy-related matters.
