Benjamin focuses his practice on litigation involving complex commercial disputes and Delaware business entities. An experienced litigator, he represents clients in a wide range of corporate, business, and commercial disputes, including matters involving trade secrets, contracts, litigation arising from mergers and acquisitions, and statutory actions relating to Delaware business entities. Benjamin also tries complex commercial lawsuits that involve disputes arising under commercial contracts and agreements governing limited liability companies and partnerships.
Benjamin practices in all Delaware courts including the Delaware Supreme Court, the Delaware Court of Chancery, and the Delaware Superior Court, as well as federal appellate and district courts. He also handles arbitrations and has experience arbitrating under the rules provided by JAMS, the American Arbitration Association, the International Centre for Dispute Resolution, and the International Chamber of Commerce.
Benjamin has also devoted time to various pro bono matters, including working to secure benefits for veterans, assisting in a project to protect free speech rights of under-privileged individuals, and volunteering with the Pennsylvania Innocence Project, which works to exonerate individuals convicted of crimes they did not commit and to prevent the innocent from being convicted.
Benjamin recently co-authored the Delaware chapter of A Practitioner’s Guide to Class Actions, Second Edition, published by the American Bar Association in 2017.
