Brian Carroll is an associate in the Business Litigation group whose practice focuses on the litigation of complex contractual disputes and actions sounding in antitrust, civil RICO, consumer fraud/deceptive trade practices, breach of fiduciary duty, copyright and trademark, and misappropriation of trade secrets in the federal and state courts of New York and New Jersey.  In addition, Brian provides counsel to clients in the professional sports industry with respect to commercial transactions and sports betting compliance matters on a national level.

Prior to joining McCarter, Brian served as a judicial law clerk to Justice Faustino J. Fernandez-Vina of the New Jersey Supreme Court.

Brian graduated from Fordham University School of Law in 2014. He earned undergraduate degrees in Political Science and English, summa cum laude, from Lehigh University.

Representative Matters

Professional sports team—Successful litigation defense

Defended professional sports team and team executives in a high profile New Jersey state court litigation alleging a wide-ranging conspiracy among members of the organization to defraud memorabilia collectors by creating fake “game-worn” helmets and jerseys. Secured the dismissal, with prejudice, of nearly all of the 18 claims asserted against our clients, positioning them for an extremely favorable settlement that resolved the plaintiffs’ few surviving causes of action.

Private equity and debt investment firm—Multimillion-dollar award on summary judgment

Secured a multimillion-dollar award in favor of a private equity and debt investment firm on summary judgment in a New Jersey federal court action stemming from a failed financing arrangement.

Fortune 500 consumer products company—Proxy battle

Successfully defended a large consumer products conglomerate in defeating a proxy fight spearheaded by an activist investment fund in New Jersey state court.
